After a three year investigation and countless complaints, a south Florida man will spend 5 1/2 years behind bars for running one of the largest eBay scams in the history of eBay. The details of the massive operation include, hundreds of auction accounts, multiple identities and constantly changing PO Boxes.
In 2006, Jonathan Harkness bid and won a flashlight from an eBay seller. He sent $90 via money order, however, to his disappointment he never received his high te
ch flashlight. He was ripped off like so many other non suspecting users of eBay.
In 2007, Harkness wrote his congressman, describing the scam and alerting him that this may be part of a bigger scam. Rep. Adam Smith urged the U.S. Postal Inspection Service to investigate.
After a long three year investigation, Nilton Rossoni, 50, a Brazilian businessman with multiple aliases living in South Florida, was sentenced to 5 ½ years in federal prison for running one of the biggest eBay scams in history.
Rossoni was convicted of hauling in $717,000 from more than 5,500 eBay buyers, by creating at least 260 different eBay accounts, and using dozens of e-mail addresses with Yahoo, Google and AOL, as well as nearly 60 private postal boxes. It’s possible that Rossoni actually scammed even more users, utilizing sites other than eBay, however, the prosecution was able to gather enough evidence to get a strong conviction in this case.
This scam took place between 2003 – 2008 while he sold hundreds of different items. He maintained a strong reputation by fabricating fake buyer feedback that was positive. He also insisted on money orders or cash, and asked users not to send money via Paypal.
It’s now 2010 and people are more educated and understand Paypal helps prevent fraud. When you send cash to someone you have never met, you are taking quite a leap of faith. Be sure to always use Paypal or a similar service when sending money to someone online.

Three and a half years, 5,500 people ripped off, and apparently no comment from eBay who collected fees for each transaction, nothing from South Florida law enforcement, nothing from the FTC or FBI. I suppose it’s good the postal inspectors had a pulse, even if every other group that seems like they’d have culpability in allowing so many people to get fleeced.
I previously had a roommate whom, for the past 3 years, has been making a pretty good living off of this type of scamming. Though out of misplaced loyalty I won’t turn him in, I have tried to scare him straight by gathering information. Here’s the problem: though online scamming is completely illegal there is no one willing to enforce the law unless pressure is applied from above, as was the case in this article.
I talked to our local postmaster and she said the Postal Service does absolutely nothing about auction scamming, even if you pay extra for the delivery and signature confirmation. Ebay themselves will usually take the hit and reimburse a scammed buyer without criminally pursuing a fraudulent seller (I’m sure they have some sort of acceptable loss equation or something). And the vast majority of local, state, and federal law enforcement agencies will tell you that they’re too busy to deal with online fraud.
Its nice to see justice in this instance, but unfortunately justice is the exception, not the rule, when it comes to online fraud.

While I agree that sending cash is not a good idea, using paypal is not a safe alternative. They froze over 800 dollars in my account for several about 4 months after I sold my guitar amp (and I really needed the money) and kept asking for things you wouldn’t reasonably be able to supply, like a sales receipt for a 4 year old amplifier, and as soon as I had supplied that, they asked for yet another form of documentation. Eventually I got my money unlocked and stopped using the service, and I found out this is not uncommon for them. The link below is filled with similar horror stories

This isn’t true. In the Fall of 2009 I made a purchase and paid via PayPal. The product never arrived – the seller strung me along for 45 days, then went silent. When I turned to PayPal they told me I couldn’t file a claim as it was past the 45-day cutoff and I was out of luck.
You’re right, paypal is not perfect and can’t always get your money back. But Paypal “helps” to prevent fraud by making it harder on fraudsters.
What I can never get my head around is why, when these scammers are obviously pretty clever, don’t they just earn money honestly? They would probably end up making more and be free to enjoy it.

I have used eBay and PayPal for years and been lucky enough to never have been scammed. However sending cash to anyone you don’t know is clearly high-risk stupidity. I must also admit that PayPals policy of putting deposits from buyers ‘on hold’ until the shipment is received and waiting until positive feedback is left can be aggravating, especially when you need the money and already have a 100% positive record.
Paypal does suck. And scammers do know all the rules and the 45 day – problem too old now. So what scammers do is let things go and day 44 they put in a claim. Paypal emails you that there is a problem but if you miss your email for a couple of days… Though luck. Scammer gets money back and you are out. When you find the issue, paypal says it’s too late.
Scammers also work as buyers, that is how I got scammed thanks to Paypal 45 day bs rule. I will never-ever use eBay or Paypal (which is the same company anyway)

I just looked at Ebay user rz_nut2 AKA Mark Walsh. Those CB forums are full of “Buddy Clicks and are very ONE sided. Theer are 2 storys to every situation. I say he has good feedback at 98% Pos. I would deal with him if they were selling something I wanted. I have seen ratings much worse. Paypal is nothing but a scam and its owned by Ebay.

Ebay is helping the fraudsters. I lost over $13,000. on a car. The seller has used four ID’s (that I could find) Ebay does not care. Google ‘Tommy Denic’ to see the scam he’s using.

For god’s sake why did they take so long to catch and prosecute the guy!? I mean when I read stuff like this I am actually quite happy I still can’t use PayPal and waste some cash on eBay.
This sounds way too much like a commercial for Paypal. It makes me wonder just how long “Mr 404″ has worked for Paypal or at least accepted payment for puff pieces such as this. If you are a real journalist and not in the employ of eBay, then do your homework! There are several alternative payment sites available that do the same thing as Paypal (without their current scam of holding your money for xx-days (just for security purposes)). You can also set up your own merchant account that will enable you to take credit cards over the internet without ever having to resort to Paypal and its biased “security”. Hint: There is NO security if you are a seller, and not all that much if you are a buyer. Mostly, it’s just smoke and mirrors intended to give you that warm and fuzzy feeling while they rake your money into their pockets. It used to be a good system until eBay bought it. Now it as crappy as eBay has become. This from someone who sold on eBay since 1999. Check into eBid.com, it’s become my alternative to eBay’s abuses and self-enriching rules.
I have the same problems with Ebay as the rest of you. I am over run by scammers who try to get my money for nothing the moment I put something up for sale. And my last problem are virus guys who send me a Ebay looking mail telling me I have broken the rules, my acc have been shut down and with a link to what I did. Are you sure the guy is locked up and not operating from prison. I just got defrauded BIGTIME by someone operating out out South Florida ($8800). Some of those phishing emails we all get are ending up delivering identities into the hands of crooked people who know how to use the identities they steal. eBay makes things worse by providing lousy customer support and making it very hard for an inexperienced person to figure out how to get informed advice on what’s scam and what’s real.
Most of the “identity theft” on fleebay doesn’t come from buyer scam artists but sellers who share buyers personal info with each other and the world, usually posting it on other sites (I could give you a list). This blog is helpful, blog dot badsellerlist dot com. There are some honest sellers and buyers on ebay but the system there really doesn’t benefit honest people, only the con artists. When I was in college one of my Housemates was a very skilled eBay scammer who seriously made at LOT of money scamming people on eBay.
He would start out selling dvd or music cds or other cheap stuff for 5-10 to build up his feedback. He would often break even or even loose money on these first sales, then after he got to say 20 feedbacks, he would just start listing stuff he didn’t even own for big money.
He would get a private postal box in another city where he had to drive like 100 miles to get to it and then he would change his address and stuff with eBay to that postal boxes address.
Then he would start listing expensive things for sale on eBay in the $500 range. He would sometimes sell 5-10 items over a week period all for around $500 each. We’re talking about $5000 or more here!! He would say that he only accepted Postal Money orders in his eBay listing and sure enough people would bid on the items, running the price way up and then they winning bidder would MAIL him a Postal Money Order for $500+. I was always shocked that people would send that kind of money through the mail to a STRANGER you don’t even KNOW!!
Sure enough within a week or so this guy would drive to his Postal Box location and find it FULL of Money Orders, all made out to him for $500 each. He would make $5000 in 1 week doing this.
Then he would then deposit the Money Orders at his bank and spend a bunch of that money on a big party for our friends and everyone at the house and he would act like he was this big shot business guy who makes $5000 a week no eBay.
I’m serious, he NEVER got caught and it’s been like 4 years now. I still stay in touch and he said he had to stop doing this when eBay went to PayPal Only and banned Money Orders but during the time he did this scam over and over he made about $50,000 or more.

Ebay and PayPal do absolutely nothing to help anyone else except themselves. In the past, Seller’s where able to leave negative feedback for buyers to warn other sellers that the buyer account was scam. When the seller left negative feedback and eBay found out the buyer was scammed or their account was hacked, eBay would remove every single trace of the listing, remove all the negative feedback from the buyer’s account, and basically cover up any traces of fradulent activity. They want to place this illusion that eBay is safe, which is isnt.
PayPal is the same way. They are only interested in one thing. themselves. They got sued almost every year since eBay bought them from Intuit. They settle out of court and they sing we didnt do anything wrong. If you send someone funds via your checking account, your screwed. If you paid someone $100 and you run into a problem, if the seller has no money in that account, PayPal will send you some generated email saying sorry not our problem. They do this purposely because they know you have no means of taking the money away from them. If you do a chargeback when you pay for something with your credit card, PayPal has no control whatsoever for a credit card company or bank to take the funds away from them. PayPal isnt a bank, they arent a financial instituion, they are a company for a fee will use their credit card terinal to charge a credit card and then wire the money like an ACH into your bank account. Once you do a chargeback, the money is taken away from PayPal instantly. With a bank account, its alot harder. The only option you have with a bank account, is stating to your financial institution that you didnt authorize PayPal to take that money out.
The reason why eBay and PayPal get scammed all the time, is for one reason. Its easy to do and the scammers know eBay and PayPal wont do jack! They are only interested in themselves. They remove every single eveidence of anything that will tarish their already bad reputation. Case in point, if your a seller on eBay and you get suspended. Try to create another account, within 24 hours your shut down. If your a buyer that scammed a seller or are doing fraudulent activity, you get suspended as a buyer, you can immediately sign on with the same computer, same information and they wont do anything. They figure they scan screw with sellers because its the seller’s livelihood. And if there’s no buyer’s then they cant charge sellersa bout 15% in paypal fees, listing and commission charges. They screw over the seller and kiss the buyers butts.
As for sellers, your the front line in avoiding fraud. PayPal doesnt care, because they arent hte victim. There are two rules
1 Never ship an item out until the money is in your bank account. Your not paid until the funds are physically in your possesion. Just because a buyer sends money into your paypal account that does not mean your paid. it means paypal has the funds.
2. Always ship to a confirmed address only. The first way fraud happens is shipping to an unverified/confirmed address. Thats what scam artists do, they get a credit card and want you to ship it elsehwere. You’ll hear some sob story, its a gift, its a bday present for their niece tomorrow, etc etc. Any excuse to get you to ship it elsewhere. As with any credit card company, they will ask you one thing, did you ship it to the verified address on the credit card, if you didnt you loose.
And most importantly, never ever keep funds in your paypal account. withdraw it immediately!
Maybe if paypal were not scam artists themselves, things would be much easier. I understand people wanting to get cash sent or payment through other means rather then paypal. They run there own scams, holding funds, charging for shipping bills, if you don’t buy a shipping bill from them, they hold the money for 21 days. They charge ridiculous fees. I don’t know who is worse, paypal or BAC charging 700% on overdrafts. What this guy did and what paypal do, are similar scams, only one does in front of your face, the other does it hiding out, changing usernames.

Very rarely are these scammers brought to justice. Sometimes they even beat you on paypal by actually shipping a box with garbage inside to prove they sent something your way.
Anybody who lost money on Ebay, Paypal(even a little) should report it as loses then filling tax declaration to IRS. These steps can make the company more fairly to customers.

I have been receiving tens of items regularly.
I order an item from 24-7swords. AFTER a month the item is returned back due to “address not verified”. The item is SHOWN to be on its way back to seller via standard tracking yet the seller will NOT refund me. Reason? He needs item in his hands although he knows it IS on the way back to him.
What did I do wrong? I DID NOT FILE A REPORT WITHIN 45 DAYS BECAUSE I TRUSTED THE FRAUDELENT SELLER!!!!

Customer bought item and we ship it to him. His address was incorrect. Here is the address: EC642747245US. It was shipped with USPS. He lost the case with eBay and paypal because he did not provide us with the correct addess. I told him he will be getting a refund on his item once we receive it back in our hands and he still did not believe.
I know tons of sellers who use SHILL accounts, EBAY will not do anything to stop them. Notice how the Post Office had to finally investigate?
I maintain numerous accounts on EBAY, and as long as I make enough money for EBAY in fees – they will never take any action against me. It is a cold hard fact!

eBay and PayPal are complict in the crimes that are committed through their business. And that if these same offences were committed at your local department store, the directors of would have some lengthy jail time.
In addition, eBay & PayPal still take commissions on fraudulent transactions, meaning that they are knowingly profiting from the proceeds of a criminal offence. I wonder how much this adds up to?
